ResMedX services are intended for authorized healthcare providers and organizations only. You agree to use the platform solely for lawful purposes and in compliance with all applicable laws and regulations, including HIPAA and other relevant healthcare privacy regulations.
4. Data Privacy
We are committed to protecting your data. Any personal or patient information stored on our platform is handled in accordance with our Privacy Policy and applicable data protection laws. You are responsible for ensuring that your use of the platform complies with applicable privacy obligations.
5. Subscription and Billing
Access to ResMedX requires an active subscription. Subscription fees are billed as per the selected plan. By providing payment information, you authorize us to charge the applicable fees. Refunds are subject to our refund policy.
6. Prohibited Activities
You agree not to misuse our services, attempt unauthorized access, distribute malware, or engage in any activity that disrupts the platform or violates applicable laws.
7. Termination
We reserve the right to suspend or terminate your account if you violate these Terms. You may also cancel your account at any time by contacting our support team.
8. Limitation of Liability
To the maximum extent permitted by law, ResMedX shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform.
9. Changes to Terms
We may update these Terms from time to time. Continued use of the platform after any changes constitutes your acceptance of the revised Terms.

Privacy Policy
Privacy Policy
ResMedX ("we", "us", or "our") is committed to protecting the privacy and security of the information entrusted to us. This Privacy Policy explains how we collect, use, disclose, and safeguard your information, including Protected Health Information (PHI) governed by the Health Insurance Portability and Accountability Act of 1996 (HIPAA).
1. Information We Collect
We collect information you provide during registration and use of the platform, including your name, contact details, organization information, and any patient or clinical data you enter into the system. We also collect technical data such as log files, device information, and usage activity.
2. HIPAA Compliance
ResMedX is designed to support your organization's compliance with HIPAA. We implement administrative, physical, and technical safeguards to protect the confidentiality, integrity, and availability of electronic Protected Health Information (ePHI) in accordance with the HIPAA Security Rule.
- Access Controls: Role-based access ensures that users only access the information necessary for their role.
- Encryption: ePHI is encrypted in transit and at rest using industry-standard protocols.
- Audit Controls: System activity is logged and monitored to detect and respond to unauthorized access.
- Breach Notification: In the event of a breach of unsecured PHI, we will notify affected parties in accordance with the HIPAA Breach Notification Rule.
3. How We Use Your Information
We use the information collected to provide, operate, and maintain our services, to process transactions, to communicate with you, to improve the platform, and to comply with legal obligations. We do not sell your personal information or PHI.
4. Disclosure of Information
We may disclose information to trusted service providers who assist us in operating the platform, subject to confidentiality and Business Associate obligations, or when required by law. Any disclosure of PHI is limited to the minimum necessary and consistent with HIPAA.
5. Data Retention
We retain information for as long as necessary to fulfill the purposes described in this policy, to comply with our legal obligations, resolve disputes, and enforce our agreements.
6. Your Rights
Depending on your jurisdiction and role, you may have rights to access, correct, or request deletion of your personal information. Requests concerning patient PHI should be directed to the covered entity responsible for that data.
7. Security
We maintain reasonable administrative, technical, and physical safeguards designed to protect your information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
8. Changes to This Policy
We may update this Privacy Policy periodically. We will post the revised policy with an updated effective date. Your continued use of the platform constitutes acceptance of the revised policy.

BAA Compliance
Business Associate Agreement (BAA) Compliance
This Business Associate Agreement ("Agreement") supplements and is made part of the Terms & Conditions between your organization ("Covered Entity") and ResMedX ("Business Associate"), as those terms are defined under the Health Insurance Portability and Accountability Act of 1996 and its implementing regulations (collectively, "HIPAA").
1. Purpose
As a Business Associate, ResMedX may create, receive, maintain, or transmit Protected Health Information (PHI) on behalf of the Covered Entity. This Agreement establishes the permitted and required uses and disclosures of PHI and the safeguards ResMedX will implement to protect it.
2. Permitted Uses and Disclosures
ResMedX will use or disclose PHI only as necessary to perform the services described in the underlying agreement, as required by law, or as otherwise permitted under HIPAA. ResMedX will not use or disclose PHI in any manner that would violate HIPAA if done by the Covered Entity.
3. Safeguards
ResMedX will implement appropriate administrative, physical, and technical safeguards, consistent with the HIPAA Security Rule, to prevent the use or disclosure of PHI other than as permitted by this Agreement, and to protect the confidentiality, integrity, and availability of electronic PHI.
4. Reporting
ResMedX will report to the Covered Entity any use or disclosure of PHI not provided for by this Agreement of which it becomes aware, including breaches of unsecured PHI, without unreasonable delay and in accordance with the HIPAA Breach Notification Rule.
5. Subcontractors
ResMedX will ensure that any subcontractors that create, receive, maintain, or transmit PHI on its behalf agree in writing to the same restrictions and conditions that apply to ResMedX with respect to such PHI.
6. Access, Amendment, and Accounting
ResMedX will make PHI available to the Covered Entity as necessary to satisfy the Covered Entity's obligations regarding an individual's right to access and amend their PHI, and to provide an accounting of disclosures, in accordance with HIPAA.
7. Return or Destruction of PHI
Upon termination of the underlying agreement, ResMedX will, if feasible, return or destroy all PHI received from, or created or received on behalf of, the Covered Entity. If return or destruction is not feasible, ResMedX will extend the protections of this Agreement to such PHI.
8. Term and Termination
This Agreement is effective as of the date the Covered Entity accepts the Terms & Conditions and remains in effect until all PHI is returned or destroyed. The Covered Entity may terminate the underlying agreement if ResMedX materially breaches this Agreement and fails to cure such breach within a reasonable period.
